Lake Club History

T

he following incorporates the Lake Club history as recorded on year 25.  On an afternoon in late 1956, 30 men gathered in Ralph and Anita Pereida’s Hickock Road playroom to discuss forming a recreational family club in the Thayer Lake area (Anita Pereida is still a member today and one of our original bond holders).  Those present recognized that there was a real need in the community for a family pool and tennis club.  New Canaan had no town beach access, the YMCA had yet to be built, the Field Club had not opened and there were limited opportunities at local area country clubs for young families.  Principals at the initial meeting, beside host Pereida, included Charley St. Thomas, who became the first president, Charley Kircher, Marcy Sellew, Jack Reed, Ed Rabe, O.V. Lindell, Al Bouchard, George Hupman, Paul Gadebusch, W.J. Dickson, Lou Annunziato, Walt Mannini and Hart Evans (who just resigned from the Lake Club in 2007).  Those present took up the daunting task of organizing the purchase of land and recruiting members.  Each man contributed $15 to retain a lawyer.  

In March of 1958, the formation of the Lake Club and its membership drive were formally announced in the New Canaan Advertiser, with land selected skirting Thayer Lake.  The property chosen was one of the few unspoiled wilderness sites remaining in Fairfield County.   Just a few yards from the present tennis practice wall, hunters had built a duck blind in a tree, and there was a campsite near a tiny island in the lake.  The land was owned by Parting Brook Partners and was accessible by only a dirt road that ran off of Mariomi and dead-ended into the Lake Club’s property.  It would be the late 1960’s before Thayer Pond Road was extended into Wilton.  The purchase price for the original 11.2 acre parcel was $36,000.  During the summer of 1958, the club was opened, although there were no man-made facilities, just the natural beauty of the woods and the lake.  The only activities were ones that revolved around the lake--picnicking, fishing, boating and skating.  Those members acting as principals would be on hand every weekend during the summer of 1958--they hosted several open houses for potential members to tour the property and discuss where the proposed facilities would be built.  Hundreds of families came to look at the land that first summer, but actual memberships were slow to come.  The goal was to recruit 300 member families.  Each “charter” family was required to purchase a $550 bond, with annual membership dues of $100 per family.  The capital raised from the sale of bonds would build the facilities over the winter of 1958-1959 with a proposed budget of $225,000.  They would include a swimming pool, bath house and snack bar, three tennis courts, and a year-round club house overlooking Thayer Lake. 

Membership recruitment started in earnest during the fall of 1958.  Members held cocktail parties, dances, and dinner parties.  Ralph Pereida, a commercial artist who hosted the initial meeting in 1956, designed the original brochure and a large scale model illustrating the club’s facilities.  Mr. Pereida and others spent many Saturday mornings on the streets of downtown New Canaan, talking with passers-by about New Canaan’s newest family club and signing up members. 

Through the hard work and dedication of our founding fathers, construction began in February, 1959 with the hopes of completion before the July 4th planned opening.  The club had taken out an initial loan of $60,000 to finance the building over the spring in addition to the funds they had raised through the sale of bonds.  There were many problems facing the board.  Many who indicated interest in the club, had taken a “build it first and then we will join” attitude.  Funds were tight, but the belief and commitment of the organizers never wavered.  Two board members sought the help of a local bank, and with their own collateral, secured the funds needed to bridge the gap.

In anticipation of the club’s summer opening and with publicity always in mind, the Lake Club hosted a Founder’s Day Dinner in May of 1959.  One of the club’s organizers, Chet Hansen, served as aide-de-camp to General Omar Bradley during WWII and he invited the general to be the keynote speaker.  The general’s visit to town became front page news here, made the New York Times and generated great interest in the opening of the Lake Club.

After one postponement, the Lake Club formally opened on July 18, 1959.  In place were three tennis courts, the pool and bathhouse and a snack bar.  After the article appeared in the New Canaan Advertiser, the club was swamped with applications.  With this initial success, it was announced in September 1959, that the number of charter memberships would be closed (the goal of 300 member families had still not been reached).  The board pressed on with the last piece of the original plan: the completion of a year-round clubhouse atop the rocky escarpment overlooking Thayer Lake and the pool.  The clubhouse was to have a large meeting/dance space, a kitchen and locker and bath facilities.  The cost of the project would have to be funded by additional bonds.   Although backed fully by the board, the membership voted down the building of the clubhouse, primarily for its $100,000-plus price tag.  The proposal has been revisited at various times over the first 20 years of the club’s existence, but has never come to fruition. 

Construction continued over the next couple of years.  The Fun Deck was added in 1960, to provide a permanent picnic area adjacent to the pool.  Tennis courts 4, 5, & 6 were added in 1961 along with the first two paddle courts.  A Long Range Planning committee was established in 1964.  After careful review the committee made several recommendations of which we are the beneficiaries.  The committee recognized the growing popularity of paddle tennis and reaffirmed the club’s commitment to the sport.  They advocated the expansion of the program, including building more courts and a permanent Spectator House.  In 1965, the original Spectator House was constructed along with 2 additional paddle courts (the bathroom facilities were later added in 1974).  The committee recommended the installation of a permanent awning along one side of the pool deck (realized in 2007).  Lastly, the committee concluded that adding or expanding the club’s activities would, in time, require more land.  The club was advised that the owner of the adjacent property to the north and east of the club planned to dispose of his entire parcel--150 acres, at $2000-$2400/acre.  Although recognizing this as a sound investment, it was financially prohibitive for the club at the time.  Instead, they advocated entering into some type of option agreement to purchase enough adjoining lots to adequately cover any current or future expansion programs the club contemplated for basic facilities.  The committee “believes that two lots can be acquired for a maximum total cost of $16,000 under an option arrangement negotiated to provide a minimum of four years (or preferably longer) in which to acquire the property.”  The records are unclear, but the committee’s recommendation must not have been acted upon.  What we do know is that an additional 2.32 acres, on which courts 9/10 & 11/12 are currently located, was purchased in 1969 for $33,000.  The deal was made possible through the help of the Brentano family (Remember Brentano’s Books in NYC?  They were members of the club).  The Brentano’s made a bridge loan to the club for the purchase price, enabling us to acquire the land.  Subsequent to the purchase, the club obtained a mortgage to fulfill their obligation to the Brentano family.  In 1974, Courts 7&8 and 9&10 were added. 

The Lake Club enjoyed its fifteen minutes of fame in August of 1966 when Hollywood came to town.  The Lake Club was transformed into a public pool for the filming of “The Swimmer”, starring Burt Lancaster.  Burt dove from our rock into the pool on his quest to “swim home across the country”.  Lake Club members, including John Wilson, acted as extras in the film.

The Lake Club has been a competitive force in Fairfield County from the beginning.  The swim team began just a few weeks after our pool opened in 1959 and within weeks, they had won their first swim meet against the Wilton Riding Club.   The competitive spirit of the Lake Club was born.  Over the years, the Lake Club Tigers have won the Division I title 15 times—more than any other club, and dominated the league in the 1980’s, winning the title 11 straight years.  The Lake Club was one of the founding members of the Fairfield County Tennis League in 1966.  Currently our club has six teams playing in the league and has been the host to the New England Men’s 60+ USTA Singles Sectionals from 2000-2003.

The Good Old Boys (GOBs)

This group was the brainchild of Alex Reddin of Norwalk, and a longtime member of the Milbrook Club in Greenwich where he lived for many years.  After a game one day with Art Hill, New Canaan Field Club, Jack Gillespie, Lake Club and Tad Brown, Shore and Country, Mr. Reddin commented to them that it was hard for him to get a good game at his club during the week for lack of players.  Art, Jack and Tad agreed that the same was true of their clubs.  Using the contacts he had gained as the organizer of the Fairfield County Tennis League in 1966, he approached all of the league clubs.  His plan was simple: to persuade them to each grant free court time two days a season to GOBs.  It became obvious that others sought the opportunity to mix with their contemporaries, make new friends and keep old ones.  Alex dubbed the group the Good Old Boys and the league was created.

Play began at Weeburn in the spring of 1983.  GOBs has grown over the years and now boasts 100 members.  Matches now rotate between 18 area clubs with play restricted to 4 times a season from May to October at each club.  The range of skills and abilities varies widely since member’s ages are between 55 and 90 with the average age about 75.  Play is usually three times a week from 9 AM to noon.  Members are expected to play at least eight times a season.  Participating clubs are restricted to 7 GOBs members and most are fully retired.  The current members from the Lake Club are: Harry Hitch, Dick King, Bill Kirby, Bob Lanna, Pat Morgan, Peter Moyer and Tom Walker.  Jim Lisher, Tom Ferguson, Arun Daga and Andy Tarnowski are on the wait list.

Play is informal; as players show up they form teams.  After each set, the foursomes split and seek new partners.  The average turnout is 24.  An executive committee elected in October runs the operations of the group with a fee of $15 a year from each member.  Every year a portion of the membership dues is donated to a local organization in support of junior tennis development. 

GOBs has also lead to the development of other special interest groups as an offshoot of its membership, including golf, bridge, skiing, poker and paddle tennis.  There are now several couples and ladies events during the year as well.

Except for the addition of our current Pro Shop in 1987, our club remained unchanged for many years.  In 1994 Courts 11&12 were added transforming the Lake Club into the largest tennis facility in the Fairfield County Interclub League.  The original pool and bath house were replaced in 2000 and 2004 respectively.  Our new Spectator House provides significant views of our paddle and tennis courts and is an exceptional venue for year round hospitality.

The Lake Club and its Board of Governors will continue its commitment to provide its membership with superior swim, paddle and tennis programs, quality staff, family oriented activities and a top notch facility.

ARTICLE I.  NAME AND PURPOSE

The name of this Club is THE LAKE CLUB, INC., and its purpose is the maintenance of a club for social enjoyment.

ARTICLE II.  OFFICERS

Section 1. The officers of this Club are a President, a Vice President, a Secretary and a Treasurer.  The President and Vice President will be chosen from the Board of Governors (“Board”) annually by the Board. The offices of Secretary and Treasurer need not be held by members of the Board or of the Club, and may be held by the same person.

Section 2. PRESIDENT. The President will preside at the meetings of the Club, be Chairman of the Board, be Chief Executive Officer of the Club, and will be ex-officio, a member of all standing committees except the nominating committee.

Section 3. VICE PRESIDENT. The Vice President will have all the powers and perform the duties of the President in the latter’s absence and perform such other duties as may be assigned by the Board.

Section 4. SECRETARY. The Secretary will record and keep minutes of meetings of the Club and of the Board, and have custody of the Club seal, and all books, records and papers of the Club except those required by the Treasurer. The Secretary will conduct all official correspondence of the Club except that of a financial nature attended to by the Treasurer, give due and proper notice of all meetings where notice is required by the bylaws, and perform such other duties as may be assigned by the Board.

Section 5. TREASURER. The Treasurer will collect and receive the monies due and owing to the Club, have custody of its funds and securities, keep regular and correct accounts, pay or cause to be paid all bills upon being duly certified as to their correctness, make interim reports to the Board at such times as it designates, make a yearly report for presentation to the annual meeting, and perform the usual duties pertaining to the office.

Section 6. The President, Vice President and Treasurer may be bonded, the amount and nature of each such bond to be determined by the Board and the cost to be paid by the Club.

Section 7. The Club will indemnify to the full extent permitted by, and in the manner permissible under the laws of the State of Connecticut, any person made or threatened to be made a party to an action or proceeding, whether criminal, civil, administrative or investigative, by reason of the fact that he or she, his or her testator or intestate, is or was a Governor or officer of the Club. This indemnity will only apply if such person offers the Club the right to defend such action or proceeding at the Club’s expense, and provided further that if the Club does not accept such offer, the Club will reimburse such person for the cost of the defense. This provision will be deemed a contract between the Club and each Governor and officer who serves in such capacity at any time while this bylaw is in effect, and any repeal or modification will not affect any rights or obligations then existing with respect to any state of facts then or theretofore existing, or any action, suit or proceeding theretofore or thereafter brought based in whole or in part upon such state of facts.

ARTICLE III.  ORGANIZATION OF THE BOARD OF GOVERNORS

Section 1. The Club will be managed by a Board of Governors (“Board”) consisting of nine (9) members of the Club. The nine (9) Governors will be divided into three (3) groups of three (3) each. The terms of the three groups will expire in successive years. At each annual meeting three (3) Governors will be elected for a term of three (3) years to replace the Governors whose terms have expired. A Governor who has served two (2) successive three (3) year terms on the Board will not be eligible for re-election to the Board until a year has elapsed following the completion of his or her second term.

Section 2. If a vacancy occurs on the Board other than by the expiration of a term of office, the Governors will by a majority vote elect a member to serve on the Board until the next annual meeting at which time the membership will, by the election procedures of the bylaws, elect a member to fill the remainder of the unexpired term or to serve a full term, as the case may be.

Section 3. Any member of the Board may be removed from office by a majority vote of the total membership of the Club at any annual or special meeting.

Section 4. Neglect on the part of any Governor to attend three (3) successive regular meetings of the Board will be considered a tender of his or her resignation from office, unless such absence from the meetings is caused by illness, temporary absence from the area, or is otherwise excused by the President.

Section 5. Any member of the Board who ceases to be a member of the Club will automatically cease to be a member of the Board.

Section 6. Regular meetings of the Board will be held at least once in every calendar quarter, and may be held more often at the discretion of the Board. A meeting will be held within two (2) weeks following the annual meeting of the Club for the purpose of electing officers. Each officer will hold office until the corresponding meeting in the next year and until a successor has been elected and duly qualified. Any vacancy in any office will be filled for the unexpired portion of the term by the Board at any regular or special meeting.

Section 7. Special meetings of the Board will be called by the President, or by the Secretary upon the request of three (3) members of the Board.

Section 8. The Board meetings will be held at such places and in such a manner as the Board determines.

Section 9. Notice of regular and special Board meetings, stating the day, time and place of the meeting will be given to each member of the Board via electronic mail or by mailing written notice thereof to his or her residence at least seven (7) days before the date of the meeting. Failure to provide seven (7) days’ written notice prior to a meeting of the Board will not impair the validity of any action taken, provided a written waiver is signed by all members of the Board.

Section 10. Except as otherwise provided herein, a majority of the Board constitutes a quorum for the transaction of business at any meeting. Except as otherwise provided herein, the vote of a majority, a quorum being present, constitutes an act of the Board.

Section 11. A former President of the Club, if not an elected member of the Board during the first year after the termination of his or her term as President, will be an ex-officio member of the Board during said year and is eligible to attend all meetings, regular and special, of the Board but will not have a vote on the Board.

ARTICLE IV.  POWERS AND DUTIES OF THE BOARD OF GOVERNORS

 

Section 1. The Board will have all the powers which may be exercised by Directors of a not-for-profit corporation under the statutes of the State of Connecticut. Without limitation of the generality of the foregoing, the Board will also have the power to:

a)        elect Club members and officers;

b)       make rules for its own governance;

c)        control and manage the grounds and facilities of the Club, including any real estate owned or leased by the Club, and to transact all Club business and make and amend rules for the regulation and use of the Club property;

d)       appoint and remove such agents, servants and employees as it may deem necessary and fix their duties and compensations;

e)        make and authorize the lease, sale or purchase of real estate and make and authorize contracts for the purchase of personal property, repairs and supplies.

Section 2. The Board will present at each annual meeting of the membership a report verified by the President and Treasurer, setting forth the financial status of the Club and a description of its activities.

Section 3. The Board will cause the books of the Club to be audited or reviewed annually by independent, non-member, auditors, selected by the Board, and the report of the auditors will be available to the members at all times.

Section 4.

a)        The Board will designate a bank or banks in which the funds of the Club will be deposited and determine the manner in which checks, drafts and other instruments for the disbursement of funds of the Club will be executed.

b)       All checks, drafts, or similar instruments drawn in the name of the Club for Club disbursements must be signed by the President, Vice President, or Treasurer, with the signature of two of said officers being required for Club disbursements in excess of $5,000. However, the Club Manager is authorized to sign checks up to $5,000 for budgeted expenses.

c)        Any Club employees authorized to handle Club funds in any manner may be bonded, the amount and nature of such bond to be determined by the Board and the cost to be paid by the Club.

Section 5. The Board will constitute and appoint such committees as the Board deems desirable for the proper management of Club affairs and will define the powers and duties of such committees.

ARTICLE V.  MEMBERSHIP

 

Section 1. Membership in the Club is divided into seven (7) classes:  (a) Regular, (b) Junior, (c) Junior Associate, (d) Associate, (e) Senior Associate, (f) Inactive, and (g) Non-Resident Active.

Section 2.

a)        Regular Membership is open to a husband and wife, to the head of a family and to an individual adult. A Regular member is entitled to but one (1) vote in all Club affairs, whether the membership is held by an individual or jointly by a husband and wife. For the purposes of these bylaws, a husband and wife shall be considered one member.

b)       Junior Membership is open without extra charge to unmarried children, living in the homes of Regular members through the calendar year of their 22nd birthday.

c)        Junior Associate Membership is open to unmarried children of Regular members between the ages of 22 and 28. Such members will not be required to pay initiation fees and the annual fees will be 1/3 of the regular annual fee through the year of the 24th birthday and 1/2 through the year of the 28th birthday. At that time this membership will terminate, however, the Junior Associate member may apply for a Regular Membership subject to the regular fees within ninety (90) days of the termination. If the Junior Associate is accepted as a Regular member, the initiation fee may be paid in three (3) annual installments. A Junior member will have priority over a non-member if, at the time of request for reinstatement, the Regular Membership is at its limit. However, for those who are full time students; undergraduate, graduate or pursuing a professional degree, and whose legal address is the residence of the parent(s), the Board will consider waiving the annual fees upon receipt of a written request for that period of time that the Junior Associate member remains a full time student, but not beyond the 28th birthday.

d)       Associate Membership is open to individuals between the ages of 21 and 30. There will be no more than ten (10) Associate members at a time. Such members will be required to pay full initiation fees over a number of years depending on their age at the time of final Board approval of their membership. The annual fees will also be charged on a reduced basis as determined by the Board and set forth in the annual directory. At age 31, the Associate Membership will terminate and may become a Regular Membership subject to the then applicable annual fees provided the initiation fee is fully paid.

e)        Senior Associate Membership. Any Regular member of the Club may become a Senior Associate member effective as of January 1 in the year in which he or she turns 65 years of age or any year thereafter if he or she has been (a) a Regular member for the 10 years immediately prior to such day, or (b) a Regular member for the 11 years immediately prior to such day with no more than a single inactive membership period of nine (9) months or less during that 11 year period. Annual fees for this membership will be one-half of the Regular Membership annual fees. However, if any Regular member entered the Club prior to January 1, 2000 and has been a Senior Associate member for five years, the member is eligible for Super Senior status and there will be no annual membership fee charged beginning in the sixth year other than an annual maintenance fee.  For couples the determining age to qualify for Senior Associate membership and Super Senior status will be the age of the older spouse.  In addition, if a Regular Membership has been jointly held by the same husband and wife for 20 years or more, and the older member of the couple dies prior to reaching the age of 65, the surviving spouse shall be entitled to seek Senior Associate membership effective in the year in which the deceased spouse would have turned 65 years of age.  It will be the responsibility of the member seeking to qualify for Senior Associate membership or Super Senior status to apply to the Club in writing and provide such written verification of his or her age and membership tenure as the Club may require. Such written notification must be received by the Club by December 1st prior to the year in which the member seeks to become a Senior Associate member or take Super Senior status.  The Club will not refund any annual fees paid prior to such notification.

f)        Inactive Membership. Any Regular member may make written application to the Board for transfer from Regular to Inactive Membership. The granting of Inactive Membership status is discretionary with the Board but normally will be granted where a member, due to employment, health, or other reason deemed sufficient by the Board, wishes to retain his or her membership during a period when unable to use the facilities of the Club. An Inactive member may not make use of the Club facilities or participate in Club functions other than as a guest of a Regular, Junior Associate, Associate, or Senior Associate member. In no event shall an Inactive member be a guest more than 4 days per year. The annual fees and dates of payment thereof, for Inactive Membership, will be fixed by the Board. An Inactive member will not be liable for any special or general assessments levied during the period of Inactive Membership, but such assessment must be paid at the time for reinstatement to Regular, or Senior Associate Membership. An Inactive member will have priority over a non-member if, at the time of request for reinstatement, the Regular Membership is at its limit.  A member may remain inactive for a maximum of three (3) years, except that in the case of unusual hardship, the Board may extend the Inactive Membership for a period not to exceed two (2) years.

g)       Non-Resident Active Membership. Any Regular or Inactive member may make written application to the Board for transfer to this class if he or she resides more than one hundred (100) miles from the Club. Upon approval of the Board the Non-resident Active member will have all the privileges of a Regular member for a period not to exceed three (3) weeks per year except that such member will not have a right to vote. The fee will be one-third the Regular Membership fees.

Section 3. Those who were Regular members in good standing of the Club when the total of Regular Memberships first reached three hundred (300) are deemed Charter members and constitute the Charter Membership of the Club.

Section 4. Candidates for membership must be personally known to and recommended by at least seven (7) Regular or Senior Associate members.

Section 5. The Board will vote upon the admission to the Club of each applicant for Regular or Associate Membership and will confer membership only upon those applicants who are approved by at least five (5) members of the Board.

Section 6. A candidate for membership who has acquired the title to the principal residence of a member owning a bond who has resigned from the Club will be given priority over all other candidates in consideration for membership.

Section 7. A candidate for membership who is the child of a member owning a bond who has resigned from the Club and who does not receive the benefits of Section 6 of this Article V will, upon the written request of the member to the Club at the time of his resignation, be given priority over all other candidates in consideration for membership. The privilege will be open to only one child of any one member.

Section 8. Any member of any class of membership may resign from the Club at any time, subject to the provisions of Article VI of these bylaws. There will be no refund of the current year’s fees and any fees and/or charges due at the time of resignation must be paid. Resignations should be in writing sent by Registered or Certified Mail directed to the Membership Chairman, and will be effective as of the postmarked date of the envelope containing same, unless a later date is specified in the letter.

a.        Upon resignation, membership in the Club will immediately cease and the use of the Club or any of its facilities as a member will no longer be permitted unless and until a former member is readmitted to the Club.

b.        Former members who were not suspended or expelled from the Club, and who otherwise are deemed by the Board to have resigned in good standing, may be readmitted to the Club at the sole discretion of the Board and subject to space availability, as follows:

1.        They submit a written request for readmission as a Regular member to the Membership Chairperson by Registered or Certified mail with updated member information within five (5) years of the date of their original resignation.

2.        They pay all assessments that have been due and payable during each year since the date of resignation and any other outstanding fees, dues and assessments.

3.        For each partial or full year since the date of resignation, they pay the annual fee set by the Board for Inactive membership as established pursuant to Article V of the Bylaws and the rules of the Club.

4.        In addition, they pay two times the total amount of inactive fees due under subparagraph 3 hereof.

5.        All amounts due under this subsection b, and all current dues, must be paid before any former member is readmitted to the Club.

6.        A former member who meets the requirements for readmission under this Section 8 will have priority on the waiting list for membership in accordance with the terms of Article IX, section 3(h).


Section 9.

a)        Any member of any class of membership may be suspended from the Club for cause for a period not exceeding three (3) months, or expelled from the Club by an affirmative vote of at least seven (7) members of the Board present at a meeting. Cause for suspension or expulsion will be, in general, violation of the bylaws or of the rules of the Club, or conduct incompatible with the best interests of the Club.

b)       The Board may delegate to the Chairman of any committee or to a responsible employee of the Club the power to suspend the pool or other Club privileges of a Junior member for violation of the rules of the Club, provided such suspension does not exceed seven (7) days. A written report of such suspension, containing the reasons therefore, will be submitted promptly to the President of the Club and to the parents or guardian of the Junior member so suspended.

Section 10.

a)        Membership in the Club is limited to three hundred (300) Regular Memberships.

b)       This Section 10 of this Article may not be amended or abolished except upon approval by a two-thirds (2/3) majority of all the Regular members of the Club entitled to vote at an annual or special meeting.

Section 11. In the event of a divorce, the individuals involved will elect at the time of divorce which of the two will continue as a member of the Club and will notify the Secretary in writing of such election. Failure to make such an election is grounds for termination of the membership. The person so elected will thereafter be a member with all of the rights and obligations of such membership but without payment of a new initiation fee. The non-elected person may become a Regular member by paying the initiation fee in force at that time within thirty (30) days of the election. Failure to make such payment will terminate the non-elected person’s relationship with the Club except for settlement of prior incurred charges.


ARTICLE VI.  ASSESSMENTS, FEES AND DUES

 

Section 1.

a)        The Club initially raised some or all of the funds necessary for acquiring and/or improving its properties and facilities, and/or for its operations, through the issuance of Bonds. The Bonds were non-interest bearing with the face value of Five Hundred Fifty Dollars ($550.00) each. No Bond was issued for less than its face value.

b)       The Bonds are not transferable, and each contains an appropriate notation to that effect on its face thereof.

Section 2.

a)        No member of any class of membership in the Club was required to purchase a Bond as a condition precedent to his or her membership or as a condition of continuing his or her membership in the Club.

b)       Each member accepted into membership after the charter membership closed, as a condition of precedent to membership, is required to pay an initiation fee determined by the Board.

Section 3.  A holder of a Bond may redeem his or her Bond at any time after the Club membership is filled for its full face value thereof less any indebtedness owing by the holder to the Club.  The manner in which the Bonds are redeemed is determined by the Board provided, however: (1) that each Bond owned by a non-member will be redeemed within sixty (60) days of presentation for payment; (2) that each such Bond of a member shall be redeemed in the chronological order in which memberships terminate (except as otherwise provided in these bylaws), and only as soon as an initiation fee is received from a new member. Except for the redemption payment as herein provided, each Bond becomes null and void upon the date that the holder thereof requests redemption of the Bond. The Club may redeem the Bond of any member in accordance with the above provisions without his or her request upon cessation of his or her membership for cause, and after such redemption the Bond is null and void.

Section 4.  In the event of the dissolution of the Club in any manner or for any cause, and in no other event, upon the effective date of dissolution of the Club, each Bond will be a lien upon the proceeds of the sale of the property of the Club after the payment of all of its just debts and obligations to the extent of the face value of the Bond, subject to set-off of all debts, fees and obligations owed by the holder of the Bond. After payments of all Bonds outstanding upon the effective date of dissolution of the Club the surplus remaining will be paid and distributed pro rata among the members of the Club on said date of dissolution.

Section 5. Each membership will be responsible for the payment of all charges or liabilities that may be imposed upon or incurred by that member, their guests, their children, or their children’s guests. 

Section 6.

a)        Any member failing to pay his or her indebtedness to the Club within thirty days after date of billing may be charged the greater of a $10.00 delinquency fee or a monthly finance charge of 1.5% of the outstanding balance. The name of any member failing to pay any indebtedness to the Club within fifteen days after the third regular monthly billing of such indebtedness and the amount due may be posted on the Club bulletin board at the end of said fifteen days, and the name may remain posted until the indebtedness is paid.

b)       Any member failing to pay his or her indebtedness to the Club before the fourth regular monthly billing will automatically be suspended as of the date of such billing. When a member is thus suspended neither the member nor anyone claiming membership through the member will use any Club facilities or be permitted any Club privileges during such suspension.

c)        Any member failing to pay any indebtedness to the Club within thirty (30) days after suspension under (b) above, may be expelled from membership in the Club by action of the Board under Section 8A of Article V hereof. The Board in its discretion, may reinstate any membership thus terminated, upon written request for reinstatement and the payment of all indebtedness to the Club.

Section 7. Annual fees, the initiation fee, assessments not applicable to Section 10 (a) below, and the method and dates of payment will be fixed by the Board. Fees and payment responsibilities will be published in the annual directory.

Section 8. Fees will be charged for swimming, tennis, and paddle lessons and other club activities as determined by the Board. The amounts will be posted prominently at the Pool Office, Pro Shop, and Paddle Hut, respectively.

Section 9. Section 6 of Article V and Sections 1, 2, 3, 4, and 9 of this Article VI may not be amended or abolished except upon approval by a two-thirds (2/3) majority vote of the Bond owning members as then constituted.

Section 10.

a)        No special or general assessment on the members of the Club in an amount which exceeds 25% of the annual fees in the year of the assessment payable by each Regular member will be levied except upon approval by a two-thirds (2/3) majority of all the members of the Club entitled to vote at an annual or special meeting.

b)       This Section 10 of Article VI may not be amended or abolished except upon approval of a two-thirds (2/3) majority of all the Regular members of the Club entitled to vote at an annual or special meeting.

Section 11.

a)        Members resigning before April 1 are liable for the first installment of the current year’s annual fees. Those resigning on or after April 1 but before July 1 are liable for the first two installments of the current year’s annual fees. Those resigning on or after July 1 are liable for the full year’s annual fees. A letter to the Board, Certified or Registered, must be received on or before December 31, March 31 and June 30 or the member is liable for the next one-third year’s annual fees.

b)       Members joining the Club on or before July 15 are liable for the full current year’s annual fees. Those joining after July 16, but before Labor Day are liable for 2/3 of the current year’s annual fees. Those joining on or after Labor Day are liable for one-third of the current year’s annual fees.

 

 


ARTICLE VII.  MEETINGS

 

Section 1.

a)        The annual meeting of the Club members will be held during either the month of November or December in each year, at such place and time as the Board determines. The meeting is to be within a twenty-five (25) mile radius of the Club.

b)       The annual meeting will elect Governors, present committee reports and transact such other business as may be indicated in the notice of the meeting or may be properly brought before it.

Section 2.

a)        No later than at its last regular meeting prior to the annual meeting, the Board will appoint a nominating committee of at least three (3) members which will promptly select at least three (3) members of the Club as candidates for election to the Board at the annual meeting.

b)       After obtaining the consent of those selected to run, the nominating committee will forward the names of the candidates to the Secretary, who will include the list of names with the notice of the annual meeting.

c)        In addition to the nominations of the nominating committee, any members of the Club in good standing may be nominated from the floor at the annual meeting, provided that either the candidate so nominated is present to accept the candidacy or his or her written acceptance of the candidacy is presented to the President at the meeting.

Section 3.

a)        Special meetings of the Club may be called by the Board or by the President.

b)       Upon the written request to the Secretary of twenty-five (25) Regular members, stating the reason therefore, a special meeting will be called by the Secretary within thirty (30) days.

Section 4. Notice of all membership meetings will be mailed to each member at the last known address, as indicated on the Club records, at least (5) days prior to each meeting and will state the date, time, place and purpose of the meeting.

Section 5. Each Regular member, as defined in Section 2(a) of Article V of these bylaws, in good standing on the date of any meeting, represented in person or by proxy at such meeting, will be entitled to cast one (1) vote. Junior, Inactive, Non-resident Active, Associate, and Senior Associate members have no vote.

Section 6. Twenty percent (20%) of the Regular Membership in good standing as of the date of the annual or special meeting present in person or represented by proxy will constitute a quorum at all Club meetings. Except as otherwise provided by law or by these bylaws, a majority of the votes cast at any meeting at which a quorum is present, will constitute an act of the members of the Club. If a quorum is not present at any annual or special meeting of the Club, the presiding officer may adjourn such meeting to a day and hour to be fixed by him or her, and notice of such new day and hour will be given to all members in accordance with the requirements of these laws for notice for meeting.

ARTICLE VIII.  AMENDMENTS

 

Section 1. Except as otherwise provided herein, the bylaws of the Club may be amended by the affirmative vote of at least two-thirds (2/3) of the entire Board at any regular or special meeting of the Board, provided due notice of the proposed change stating the full nature and extent thereof, will have been given to the Board in the written notice of the meeting.

Section 2. Except as otherwise provided herein, the bylaws of the Club may be amended at any annual or special meeting of the Club by the affirmative vote of at least two-thirds (2/3) of the Regular members present at the meeting or represented by proxy.

Section 3. Whenever any changes are made in the bylaws, the Secretary will provide full written notice of the change within fifteen (15) days to each member by either (a) email to the last known email address indicated in the Club records or (b) regular mail at the last known address thereof, as indicated on the Club records.  The bylaw change also shall be made in the rules posted on the Lake Club web site within the same 15 day time period.

ARTICLE IX.  ADMISSION PROCEDURES

AND MISCELLANEOUS

 

Section 1. The seal of the Club is circular in form and bears the name of the Club, the word “Connecticut” and the date “1958.”

Section 2. Any question as to the proper interpretation of any provision of these bylaws will be determined by the Board.

Section 3. Procedures to be followed for processing applications for membership.

a)        All communications regarding admission will be directed to the Admissions Chairman.

b)       An applicant must be initially sponsored and seconded by two different Regular or Senior Associate members in good standing who have belonged to the Club for one full year.

c)        Regular and Senior Associate members are limited to sponsoring or seconding three applicants per year and must be members at the time in which the application is approved by the Board. Other members may not sponsor or second applicants. Sponsors and seconders must have known the applicant for at least six (6) months.

d)       The sponsor should obtain an application for a specific applicant from the Admissions Chairman. The completed application with sponsoring and seconding letters must be sent to the Admissions Chairman by the sponsor, on behalf of the applicant. The completed application will include the names of five (5) Regular or Senior Associate members in good standing, other than the sponsor and seconder, who have agreed to write supporting letters. The sponsor, seconder and supporting letter-writers cannot all have the same business affiliation.

e)        Once the supporting letter-writers have been accepted, and when requested by the Admissions Chairman in order to fill a membership opening from the waiting list, the sponsor must collect all five (5) supporting letters and forward them, in a single package, to the Admissions Chairman. The sponsor will not solicit supporting letters until agreement has been reached with the Admissions Chairman on the list of supporting letter-writers. 

f)        When all supporting letters have been returned to the Admissions Chairman, the Board will review the entire application package.

g)       Upon concurrence by the Board, the applicant’s name will be sent to the members to solicit comments from the general membership. Members are urged to provide their comments to the Admissions Chairman or members of the Board.  Upon acceptance by the Board applicants are invited by their sponsors to a party to meet the members of the Board before final approval.

h)       Applicants will be admitted in order, as openings occur. Exceptions to this process of allowing applicants to advance to the top of the waiting list are in the following priority order:

1.        The non-elected spouse of a divorcing couple per Article V Section 11.

2.        Those applying under Article V Sections 6 or 7.

3.        Inactive members applying to reactivate their membership.

4.        Children, twenty nine (29) years of age or older, of Regular or Senior Associate members who have been members for more than ten (10) consecutive years. No more than two (2) such applicants will be admitted as Regular members to the Club in any calendar year.

5.        Those applying under Article V Section 8(b).

i)         In the event that an applicant is unable to accept the invitation for Regular Membership admission, the Board, in its sole discretion, can offer the applicant deferral for one year and may require as a condition of  that deferral the payment of an additional non-refundable application fee to be applied to applicant’s initiation fee at the time of applicant’s admission.  Additional requests for deferral shall be reviewed by the Board and handled in their sole discredtion on a case by case basis.  At any time, if an applicant declines membership, any application fees will be forfeited.  If an applicant wishes to reapply, they must begin the application process again by submitting a new application and application fee.

I.  HOUSE RULES

 

1.   Responsibility:

The Club is not responsible for personal injury or for loss or damage to the personal property of members or guests.

2.   Complaints:

Complaints as to Club services or employees should be made only to the appropriate member of the Board of Governors, the Club Manager or to the responsible Committee Chairman in writing.

3.   Suspension:

Pursuant to the provisions of Section 8(a) of Article V of the By-laws, any member of the Club or individual members of his family may be suspended by the Board of Governors for violation of the Club rules or for conduct incompatible with the best interest of the overall membership.

4.   Credit:

        (a)    Members will be responsible for all charges incurred for Club goods or services, and for any damage done to the Club property by the members, their families and guests.

        (b)   Only members may sign for Club goods and services.

        (c)    All fees and charges incurred by Club members will be evidenced by signed charge slips and will be billed to the account of the regular Club member.

      5.       Guests:

(a)    Guest privileges are available to all members.  However, on opening day, Memorial Day, July 4th and Labor Day, it is requested that members restrict the number of guests since use of the Club on these days by members is quite heavy.

(b)   Guest privileges shall be extended to the same guest no more than four times a year, except for bona fide out-of-town house guests of a member who may be issued a weekly guest card, subject to renewal at the discretion of the Club Manager. This restriction does not apply with respect to guests attending Club-sponsored social activities.

        (c)    Guests must be accompanied by a member at all times, and must be registered at the pool before using any Club facilities.

        (d)   Guests must observe all Club rules and the directions of Club representatives.

(e)      Members are responsible for the conduct of their guests at all times, and the Club Manager or his representative may require the removal of any guest whose presence is deemed prejudicial to the best interests of the Club.

(f)      Failure to sign in a guest will result in a $50.00 per person fine.

(g)     Guest fees (which include use of the pools, tennis courts, lake, and paddle courts) are as follows:

6.   Junior Program Fees:

        (a)    Junior tennis program fee will be published; supplementary fees for competitive programs may also be charged.

        (b)   Junior swimming program fee will be published; supplementary fees for competitive programs may also be charged.

7.   Alcoholic Beverages:

Consumption of alcoholic beverages by anyone, including guests, under the age of 21 is prohibited.

8.   Gambling:

No gambling is permitted on the Club grounds at any time.

9.   Smoking Policy:

No smoking of any kind, including cigarettes, cigars or pipes, shall be permitted by anyone in the following parts of the Club grounds: the Pool area, including the locker rooms and offices, the breezeway, the pool deck, the pavilion and the outdoor patio area, the Tennis Pro Shop decks during the daytime and evening tennis matches, or inside the Tennis Pro Shop and the Spectator House.  Smoking shall be permitted in other parts of the Club grounds, provided that the smoker exercises appropriate consideration for others (for example, by ensuring that his or her smoking does not disturb others’ enjoyment and minimizing smoking in the presence of children), and uses extreme caution, particularly in wooded areas.  No smoking of any kind, including cigarettes, cigars or pipes, shall be permitted at any time on the Club grounds by anyone under the age of twenty one (21), including guests.

10. Parking and Vehicles:

        (a)    Automobiles and other powered vehicles will be parked only in designated areas in the parking lot.

        (b)   Bicycles will be parked only in the designated bicycle parking area, and must be ridden slowly and carefully at all times on the Club property. They may be ridden only on the road from the Club entrance to the bicycle parking lot.  Use of skateboards and similar vehicles is not permitted on the Club’s grounds.

(c)    Speed limit on the Club property is 10 miles per hour.

        (d)   All traffic regulations and speed limits must be obeyed on Club property and on Thayer Pond Road.

11.   Club Property:

        (a)    All members are expected to cooperate fully in preserving and maintaining all Club property in good condition for the benefit of all.

        (b)   Food and drink are to be consumed on the Club property only in areas designated for these purposes.

        (c)    Papers and trash must be deposited in the receptacles provided.

        (d)   The picking, cutting or removing from the Club property of any flowers, shrubbery or wood, whether cultivated or wild, is prohibited.

        (e)    Except for members entering the office on business with an employee, only Club employees are permitted in the Club office, lifeguards’ room, kitchen areas, and filter room.

        (f)    The use of Club facilities generally is for the benefit of members and their guests.  The right to use Club facilities, including the Spectator House, may not be donated by any member for use, auction or sale at a charitable event.   The Board may, in its sole discretion, permit other individuals, groups or entities to use Club facilities, upon such conditions as the Board may determine.

12.   Bulletin Board:

Posting on the Club bulletin board shall be done with the approval of a Club officer, the Club Manager, or a designated employee.

13.   Employees:

No relative of a Club member may be a regular employee of the Club.

14.   Personal Property:

Personal property left at the Club (other than in members’ lockers) may be disposed of after thirty (30) days.

15.   Gratuities:

Under no circumstances may gratuities be given to any Club employee.


 

16.   Firearms:

No firearms, air rifles, air pistols or other weapons are permitted on Club property.

17.   Fires:

No fires are permitted on Club property except in barbecue grills, provided by the Club for the use of members.

18.  Table Reservations: 

 

During the summer season tables on the patio deck and Spectator House decks may be reserved through the Lake Club web site for Friday and Saturday nights.  Failure by a member whose plans change to cancel a table reservation by 4 pm the day of the reservation is subject to a $25 fine in the discretion of the Club Manager.

19.   Pets:

No dogs or other pets are allowed on Club property whether on a leash or not. Anyone violating this rule will be required to remove the animal from the Club immediately.

II. SWIMMING POOL RULES

 

        1.     Pool Hours:

(a)    The pool is not open and swimming is absolutely prohibited unless a lifeguard is on duty.

(b)   Regular pool hours are as follows:

                                Tuesday - Thursday                10 a.m. — 8 p.m.

                                Friday                                      10 a.m. — 10 p.m.

                                Saturday                                  10 a.m. — 10 p.m.

                                Sunday                                    10 a.m. — 9 p.m.

2.     Guests:

(a)  No one other than a member may be present at the pool unless

   registered as a guest.  Any exceptions must be approved by Club Management.

        (b)   Nursemaids and baby-sitters accompanying children to the pool must register in a book provided for this purpose, but no fee will be charged and there will be no limitation as to frequency.

        3. Safety:

        (a)    Nothing shall be taken on the pool deck which might tend to pollute the water or injure the bathers. This includes food and drink, glass containers or bottles of any kind, boats, floats or balls of any type.

        (b)   Smoking is permitted around the pool however, extreme care must be taken to avoid fire.

        (c)    The pool will be closed at the first sign of a thunderstorm and will remain closed at the discretion of the Pool Director or Club Manager.

        (d)   Use of electrical equipment of any kind is forbidden within the pool deck area during open hours of the pool. (This does not apply to battery-driven equipment).

        (e)    Before allowing a child to use a flotation device, please ask permission of the lifeguard on duty.  The use of flotation devices (i.e. swimmies) is not permitted in the adult pool unless the swimmer is under the direct and immediate supervision of an adult or accompanied in the pool by a responsible person 12 years of age or older.  These flotation devices may only be used in the shallow ends.

4.     Children:

(a)    Children under 10 years of age must be accompanied in the pool area by a person of 12 years of age or older who is responsible for their safety and conduct.

(b)   The lifeguards will determine who can use the deep end of the pool and the diving boards.

(c)    Children must pass a test approved by the Pool Director before using the 3-meter board.

(d)   Children using the wading pool should be under seven years of age and must be under the direct and immediate supervision of a person 12 years of age or older.

(e)    No child five years or younger is permitted in the adult pool unless accompanied by a parent or a babysitter 12 years of age or over responsible for the safety and conduct of the child.

(f)    No children in diapers are permitted in the adult pool.  In the event that a child defecates in the pool, the member parent will be assessed a fine of $250.00.

(g)   No babysitter is permitted to supervise children in both pools at the same time.

(h)   No babysitter may supervise more than three children from multiple families at one time.

        5.     Health:

        (a)    Persons with communicable skin diseases, colds or other infections, or wearing bandages, are not permitted to use the pool.

        (b)   All bathers must shower before entering the pool.

6.     Attire:

        (a)    Members and guests in bathing attire are restricted to the area immediately around the pool and snack bar. All members and guests approaching and leaving the pool area in bathing attire are required to wear proper outer clothing such as a suitable beach robe, footwear, etc. Standard bathing attire consists of suits designed and made specifically for swimming.

        7.     Conduct

        (a) All persons using the pool are required, in addition to observing all Club and pool rules, to accede to the instructions and directions of the Pool Director and lifeguards.

        (b) No running, pushing, wrestling, ball playing or other behavior deemed to lessen the enjoyment of other members is permitted in or around the pool.

        (c) Only one person at a time is permitted on a diving board, and dives must be completed properly.

        (d) The three-meter diving board may be used only under supervision of the lifeguards, during periods when officially opened for diving.

        (e) Towels, clothing, etc., should not be placed on the fences at any time, nor used to reserve chairs/chaises while the member is engaged in other club activities.  Lifeguards may remove such items.

        (f) Children under 16 years of age are required to place their belongings in the cubicles provided.  All members are requested to supervise their children’s compliance with this rule.

8.     Suspension:

Pursuant to the provisions of Section 8(b) of Article V of the By- laws:

        (a)    The Manager or Pool Director may suspend the pool privileges of a Junior member, for a period not to exceed three (3) days, for violation of the pool rules, and may recommend a longer suspension to the Chairman of the Swimming Committee.

        (b)   The Chairman of the Swimming Committee may suspend the pool privileges of a Junior member, for a period not to exceed seven (7) days, for violation of Club rules and may recommend a longer suspension to the Board of Governors.

        (c)             Any suspensions will be reported in writing to the parents.

9.     Private Parties

Any regular member wishing to hold a private party at the pool or barbecue areas must make arrangements in advance with the Pool Director. Parties are not to be scheduled on Friday Evenings, on weekends, or at any other time that will interfere with the use of the pool and barbecue areas by other regular members. The scheduling of a private party is in the sole and absolute discretion of the Pool Director.

 

 

III. TENNIS RULES

 

1. Tennis Rules

The Tennis Director will have the authority to interpret and enforce the tennis rules.

2. Proper Attire

Tennis whites will be required on the courts.  Shirts must be worn at all times.  Colored trim will be permitted: pastel or colored clothing will not be permitted.  Adult male members and adult male guests must wear collared tennis shirts.  Approved tennis shoes will also be required.  A flat sole, which will not damage our courts is mandatory.  Running shoes, Cross-trainers, and Basketball Shoes are not allowed.

3. Court Maintenance

Maintenance will be done in the early morning or after playing hours in the evening.  Courts will be closed periodically for watering during the warmer months.  Please always check with the Pro Shop on court availability.

4. Playability

The Tennis Director will determine whether the courts are playable.

5. The Court Use System

Courts are open for use between 8:00 a.m. to dusk.  Courts 2 & 3 are floodlit and may be used in the evening up to 10:00 p.m.  All courts may be reserved up to 3 days (72 hours) in advance, but sanctioned Club events and team practices have first priority on court use.  Most activities, however, will be planned so as to allow a minimum of two (2) courts available for regular play.  Several courts will be set aside for “Scrambles” play on Saturdays, Sundays and Holiday mornings until 10:00 a.m., EXCEPT during the three social events of the year (Memorial Day, 4th of July, and Labor Day Scramble). 

ALL COURTS WHETHER RESERVED OR OPEN WILL BE ASSIGNED BY A STARTER IN THE PRO SHOP.

MEMBERS’ PRIVILEGES

Saturday, Sunday and Holidays

Regular and associate members have court preference over children of members 18 years of age or under. 

Weekdays

All members have privileges on courts on a reserved or walk-in basis between 8:00 a.m. to 5:00 p.m., but regular and associate members have court preference over children of members 18 years of age or under after 5:00 p.m.

Monday through Friday between the hours 8:00 a.m. to 5:00 p.m., junior ladder players may book court time for official Junior Ladder challenges or social play.

6. Reserved Courts

Court time may be reserved by calling the tennis Pro Shop at 762-1663 up to 3 days in advance.  Members who reserve court time for guests will be automatically billed.

        (a)    Court reservations are available in 1-hour increments for singles play and in 1½-hour increments for doubles play during the week.  On weekends and holidays court reservation times are available in 1½-hour increments for both singles and doubles play beginning at 8:30 a.m., 10:00 a.m., 11:30 a.m., etc.

        (b)   A sanctioned Club activity may reduce the number of courts available for reserved play.

        (c)    All the names of the players should be given at the time of the reservation.

        (d)   The specific court will be assigned at the time the players report to the Pro Shop to claim the court.

         (e)   If a reserved court is not claimed by 10 minutes after the hour, it will automatically be used as an open court for the balance of that hour.

7. Open Courts

        (a)    Members and their guests must sign up with the starter in the Tennis Pro Shop upon arrival at the Club.  It is recommended to reserve a court whenever possible, as “walk on” players may have to wait until a court becomes available.

        (b)   Members playing in a club activity (Team Tournament, Men’s Scrambles, Ladies’ Scrambles, etc.) may not sign for an open court while the activity is in progress. If members who have not played arrive for courts, they will move on the waiting list ahead of members who have already played.

        (c)    Members who wish to play again after Scrambles may sign for an open court after leaving the Scrambles at 10:00 a.m. If members who have not played arrive for courts, they will be placed on the waiting list ahead of members who have already played.

        (d)   After playing for one hour, a player who wishes to play again may do so by adding his name to the bottom of the waiting list. Those who have not played will be given priority.

        (e)    If an assigned court is not claimed by the players who have been waiting for it, it will be forfeited 10 minutes after the assigned time.

8. General Rules

        (a)    All tournaments other than the five championships will be limited to regular, associate, senior and children of members 18 years of age or under.  Eligibility for Club Championship Tournaments (men’s and women’s singles and doubles, and mixed doubles) will be limited to regular, associate, senior and junior associate members; junior members not qualifying by age for Junior Tournaments, Singles Finalists of the “16 and under” championship.

        (b)   Eligibility for play in both Men’s and Women’s Inter-Club team matches will be determined by the captains of the respective teams, who take into account various factors, including, but not limited to, performance in previous club matches, performance in club tournaments and availability of all potential team players.  The captains form separate committees for the Men’s and Women’s teams and meet regularly to discuss the structure of their teams.

        (c)    Tournaments must be completed on the dates allotted to them subject to inclement weather as determined by the tournament director.  If postponement is necessary because of inclement weather, a new date will be set by the tournament director. Participants must finish play on the new date or forfeit. This rule must be strictly enforced to avoid repeated delays, which can be unfair to other participants and otherwise impede the use of the Club’s facilities.

 

IV. LAKE RULES

 

1. Swimming:

        Swimming in the lake is prohibited.  Anyone swimming in the lake will be assessed a fine of $250.00.

2. Use of Facilities:

Use of the lake and dock facilities is at the members and guests’ own risk only and the Club does not furnish lifeguard protection in these areas at all times. The presence of a lifeguard does not relieve members and guests of this responsibility.

3. Boating Rules and Safety:

        (a)   Boats must not be overloaded (no more than four persons) and the general rules of boat safety must be observed at all times.

        (b)  Everyone must wear lifejackets when in boats on the lake.

        (c)   At the discretion of the Club Manager boats may be excluded from portions of the Club lake area at designated times so as to permit safe use of the area fishing.  Such times of exclusion will be posted in advance.

        (d)  Personal boats may be used on the lake only with the approval of the Club Manager.

        (e)   Powerboats are not permitted on the lake at any time.

        (f)   Individuals who misuse the lifesaving equipment in any manner will be automatically suspended from using the lake for seven days.

        (g)  The lake will be closed at the first sign of a thunderstorm and will remain closed at the discretion of the Pool Director or Club Manager.

 

4. Fishing Laws:

The applicable laws of the State of Connecticut relating to fishing must be observed.

5. Fishing Safety:

        (a)    Fishing from shore may be done only from the designated area located behind the backboard.

        (b)   Fishing from boats may be prohibited in portions of the Club lake area at the discretion of the Pool Committee.

        (c)    Extreme care must be used in spinning and casting and may not  be done in such a manner as to endanger others or interfere with reasonable use of the lake for boating.

6. Children:

No children are permitted on the lake in boats unless accompanied by a person 12 years of age or older who is responsible for their safety and conduct.

 

V. SKATING RULES

 

1. Use:

Skating is permitted at the risk of the members and their guests.The Club does not maintain or supervise the ice. The presence of a Club employee does not relieve members and their guests of this responsibility.

VI. SPECTATOR HOUSE RULES

The Spectator House is generally intended for (a) the non-exclusive use and enjoyment of members who are playing paddle tennis or tennis                                                         and their guests, (b) cooking out on the weekends in the summer                                                   and (c)                                                      those other Club-sponsored functions as may be determined by the Board                          or              arranged in advance with the Club Manager                                               It is a non-smoking facility.

 

1.        From October 1st until April 30th (the “Paddle Season”), the primary use of the Spectator House will be as a warming hut for members using the paddle courts, and their guests.  During the Paddle Season, the Spectator House will be open from 8:00 a.m. to 11:00 p.m. Sunday through Thursday, and 8:00 a.m. to midnight Friday and Saturday.  (These closing times are one hour after the paddle court lights must be turned off.)   From May 1st until September 30th  (the “Tennis Season”), the primary uses of the Spectator House will be as (i) a pre- and post- tennis match facility for adult members using the tennis courts, and their guests, and (ii) a place for Club-sponsored activities and events.  During the Tennis Season the Spectator House will close at 10 p.m. Monday through Thursday, 11 p.m. on Friday and Saturday and 9 p.m. on Sunday.

 

2.     During the Paddle Season, the cooking facilities in the Spectator House and a maximum of four of the paddle courts may be reserved by an adult member for use in connection with a paddle party hosted by such member.  A paddle party reservation may be arranged, not more than 30 days in advance, by contacting the Club Manager or his designee, who will confirm availability, update the website reservation and provide the member with paddle party guidelines.  The scheduling of a paddle party is subject to the sole discretion of the Club Manager. Among other requirements, the member must identify all non-Lake Club guests in attendance at a paddle party and will be billed the appropriate guest fees.  Any member who makes a reservation and fails to use the reserved facilities without providing at least one week’s prior notice of cancellation may be assessed a fee of $50.  Other than the reserved cooking facilities and the west deck, the remainder of the Spectator House must remain available and accessible during a paddle party to other Club members using the other available paddle court(s).  During the Paddle Season, once a member has reserved the Spectator House for a Friday or Saturday night, that member cannot reserve the Spectator House on a Friday or Saturday evening again until the date of his/her reservation has passed.  While reservations by members for the Spectator House will generally be accepted on a first come-first served basis, the Board of Governors reserves the right to adjust the schedule to ensure that all interested members have fair and equitable access to the Spectator House during the Paddle Season. 

 

3.     During the Paddle Season, a member wishing to         use the Spectator House                    in connection with a non-paddle tennis Club-sponsored event or activity, should contact the Social Chair at least 30 days in advance for approval.

 

4.     During   the Tennis Season, the lower viewing deck, and tennis courts 2 and 3 may be reserved by an adult member for use in connection with a tennis party Friday, Saturday or Sunday evenings not more than 72 hours in advance by contacting the tennis pro shop.  The tables on the north and west decks at the Spectator House can be reserved for Saturday and Sunday evenings beginning Thursday at 5 p.m. through the patio table reservation system.  Please adhere to the cancellation and general guidelines on the web site when reserving these tables.  From May 1st through September 30th, the cooking facilities in the Spectator House may be reserved in connection with a tennis event, not more than one week in advance, by contacting the Club Manager.  Please refer to the private party guidelines posted on the web for your responsibilities. Other than the reserved cooking facilities, the rest of the Spectator House must remain available and accessible to other club members during the party.  During the Tennis Season, a member wishing to reserve the cooking facilities in connection with a non-tennis Club-sponsored event or activity, should contact the Club Manager at least two weeks in advance for approval.

 

5.       Spectator House Use

 

(a)       During the Paddle Season, children under the age of 14 are not permitted in the Spectator House unless they are (i) supervised by a parent, another adult or a babysitter at least 14 years of age or (ii) participating in a Club-sponsored function.  The paddle attendant is not on site full time and when present is not there to supervise children.  During the Tennis Season, no children under the age of 19 are permitted in the Spectator House unless accompanied by a parent or participating in a Club-sponsored function.  At no time is it appropriate for children to be left unattended in the Spectator House while parents play paddle or tennis. 

 

(b)      No member may start a fire in either the indoor or outdoor fireplaces without the aid of the Spectator House attendant.  If a member has requested that a fire be started, that member is responsible for monitoring and attending the fire, unless and until that member has contacted the Spectator House attendant requesting assistance in putting out the fire.  The Spectator House attendant may be contacted by calling the number posted in the Spectator House.

 

(c)      Members are expected to treat the Spectator House as they would their own home.  NO SMOKING of any kind – cigarettes, cigars or pipes – is permitted in the Spectator House.  No one in swimming attire, unless properly robed, is permitted in or around the Spectator House.  Members are responsible for cleaning up after themselves and their guests, depositing trash and recyclables in the appropriate receptacles and leaving the floors “broom clean”.  Any dishes, glasses or silverware that are used should be rinsed off and placed in the dishwasher.

 

(d)     No live entertainment or amplified sound is permitted outside the Spectator House.

 

(e)      The temperature in the Spectator House is automatically set to assure efficient operations, and no member should adjust any thermostat without the assistance of the Spectator House attendant.

 

(f)      The last member to leave the Spectator House is expected to make sure that the television, the cooking facilities and all other appliances such as coffee makers are turned off, the interior lights are turned off, and all exterior doors are tightly closed.

 

VII. PADDLE TENNIS RULES

 

1. Court Hours and Usage:

        (a)    The courts will be open from 8:00 a.m. until 10:00 p.m. Sunday through Thursday and to 11:00 p.m. on Friday and Saturday.

        (b)   The courts cannot be used when covered with snow or ice, which has not been removed.

        (c)    A court may be reserved by calling the reservation line 762-5600 and providing your name and phone number. Each member can reserve only one court. Please reserve courts by number and at all times use the court reserved.  If, after reserving a court, you find you will not use it, please notify the club as soon as possible.

        (d)   After 7:30 p.m. weekdays and all day Saturday, Sunday and holidays, no reservations will be made for less than four players, at least one of whom is a member.

        (e)    Children of members 18 years of age or under shall have equal rights with adults during the week except as noted above.

2. Guests:

        (a)    Paddle tennis guest privileges shall not be extended to the same guest more than four times in one year (which may be in addition to pool and tennis guest usage), except for bona fide out of town house guests who may, upon written request of a regular member, be issued a guest card on a weekly basis, renewable at the discretion of the Paddle Tennis Committee.

        (b)   The guest fees for Paddle Tennis are as follows.  It is your responsibility to see that your guests are registered at the Spectator House.

All of the foregoing fees except capital assessments and fees of less than $100 are subject to applicable taxes. Annual fees are payable in equal installments as follows: January 1, April 1 and July 1. Invoices will be mailed 30 days in advance or on December 1, March 1 and June 1.

Members resigning before April 1 are liable for the first installment of the current year’s annual fees. Those resigning on or after April 1 but before July 1 are liable for the first two installments of the current year’s annual fees. Those resigning on or after July 1 are liable for the full year’s annual fees. A letter to the Board, Certified or Registered, must be received on or before December 31, March 31 and June 30 or the member is liable for the next one-third year’s annual fees.

Members joining the club on or before July 15 are liable for the full current year’s annual fees. Those joining after July 16, but before Labor Day are liable for 2/3 of the current year’s annual fees. Those joining on or after Labor Day are liable for one-third of the current year’s annual fees.
